Terms of service
The short version
- Cutfish is a business tool for planning, making and reviewing short videos. You own your content.
- AI drafts are suggestions. You review everything before it's posted and you're responsible for what you publish.
- You also follow the rules of the platforms you connect, such as TikTok, Instagram and Google.
1. Agreement
These terms are an agreement between you and [legal company name] ("Cutfish", "we", "us"). They cover the Cutfish website and app (the "Service"). If you use the Service for a company, you agree for that company and confirm you can bind it; "you" then means the company (the "Customer") and the people it lets use the Service ("Users"). A separate signed agreement with us, if there is one, takes priority over these terms.
2. The Service
Cutfish helps brands plan short-form video content and produce it. It drafts brand profiles, ideas, scripts and video prompts with AI, imports clips you make, renders finished videos, supports a review step, and sends approved videos to connected TikTok accounts as drafts. Features change over time, and some depend on third-party services that we don't control.
3. Accounts
- You must be at least 18 and use the Service for business purposes.
- Keep your sign-in details safe, and tell us right away if you think someone has used your account without permission.
- Customer owners decide who has access and in which role, and are responsible for their Users' activity.
4. Your content
You keep all rights to the content you bring into Cutfish and the content you make with it: brand information, scripts, clips, videos, captions and results ("Your Content"). You give us permission to host, process, copy and transmit Your Content only as needed to run the Service for you, including sending it to the AI and platform providers described in our privacy policy.
You confirm you have the rights to Your Content, including any music, images, logos, likenesses and trademarks in it.
5. AI-generated drafts
- AI drafts can be wrong, incomplete or unsuitable. Review every draft before using it.
- You're responsible for what you publish, including that health, product and performance claims are true and allowed, that required disclosures (such as AI-generated content and paid partnership labels) are made, and that content follows applicable laws and platform rules.
- Cutfish's claim checks help, but they aren't legal, medical or regulatory advice.
- Similar prompts can produce similar drafts for different customers; drafts aren't guaranteed to be unique.
6. Connected platforms
When you connect TikTok, Google or another service, you also agree to that service's terms, and your use of it is governed by them. You authorize us to act within the permissions you grant: for example, to upload approved videos to your TikTok drafts and post the first comment on your own videos. You can disconnect at any time. We aren't responsible for third-party services, their availability, or changes they make to their features or rules.
7. Acceptable use
Don't use the Service to:
- publish content that is unlawful, deceptive, harmful, hateful or infringing, or that breaks the connected platform's rules;
- impersonate a real person, or make an avatar that imitates someone without their documented consent;
- hide that content is AI-generated where disclosure is required;
- spam, manipulate engagement, or post near-identical content at volume;
- access another Customer's data, probe or overload our systems, or get around limits or security; or
- resell the Service without our written permission.
We may suspend access to stop a violation or protect the Service, and we'll tell you when we can.
8. Fees
During the private beta, the Service is provided as agreed with each Customer. Any fees, usage limits (such as AI usage) and payment terms will be set out in an order form or written agreement before they apply.
9. Our property
The Service, including its software, design and the Cutfish name and logo, belongs to us and our licensors. Use of the Cutfish brand assets is covered by our brand kit. If you send us feedback, we may use it without obligation.
10. Confidentiality and data
We keep Your Content confidential and use it only to provide the Service, as described in our privacy policy. We keep each Customer's data separate from every other Customer's.
11. Ending the agreement
You can stop using the Service at any time. Either of us can end these terms with written notice, and we may end them immediately if you seriously break them. When the agreement ends, your access stops. You can ask us to export Your Content within 30 days, after which we delete it as described in the privacy policy.
12. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee any views, followers, sales or other results.
13. Limitation of liability
To the extent the law allows, neither of us is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or US$100 if you paid nothing.
14. Indemnity
You'll defend and indemnify us against third-party claims arising from Your Content, what you publish, or your breach of these terms or a platform's rules.
15. Changes to these terms
We may update these terms. We'll post the new version here, and for significant changes we'll tell Customers in advance. Using the Service after the change means you accept it.
16. Governing law
These terms are governed by the laws of [state / country], without regard to conflict-of-law rules. Disputes will be resolved in the courts of [venue].
